Important Safety, System Limitations, and Liability Disclosure

AlertBadger is designed to provide supplemental awareness and notification of activity and events on your property and should be considered only one part of a broader safety, security, monitoring, or property protection plan. While we strive to design and provide a reliable and effective product, no monitoring, alert, or awareness system can completely guarantee detection, notification, or performance in every circumstance.

AlertBadger is not a life-saving device, emergency response service, or guarantee against injury, intrusion, theft, property damage, or loss. Users should not rely solely on AlertBadger for child supervision, pool safety, personal safety, emergency notification, or any other critical safety function.

System performance may be affected by conditions and technologies outside our control, including but not limited to wireless connectivity, internet service, cellular networks, power interruptions, batteries, environmental conditions, device placement, software, third-party platforms, mobile devices, installation factors, improper installation, failure to maintain the system, user error, or other unforeseen circumstances. Delays, interruptions, missed notifications, or failures to perform may occur.

By purchasing, installing, using, or continuing to use AlertBadger, you acknowledge and agree that AlertBadger attempts to provide an additional layer of awareness and notification but cannot guarantee performance in all situations. Continued use of the product constitutes your understanding and acceptance of these limitations and disclosures currently, and as amended in the future.

To the maximum extent permitted by law, AlertBadger shall not be responsible for indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of, inability to use, delayed performance of, or failure of the system. Any total liability relating to the use of AlertBadger shall be limited to the original purchase price paid for the applicable product or service.


Monitoring App

Mobile App End-User License Agreement (EULA)

This End-User License Agreement (“EULA”) governs the use of the AlertBadger™ mobile application (“App”) provided by 2 Guy’s Marketing LLP, doing business as AlertBadger™.

By installing, accessing, or using the App, you agree to the terms of this Agreement.


1. License Grant

The Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on compatible mobile devices solely for use with authorized AlertBadger services and products.

The App is licensed, not sold, to you.


2. Permitted Use

You may use the App only:

  • For personal or business use with authorized AlertBadger devices and services
  • In accordance with applicable laws
  • In accordance with this Agreement and related Company terms

3. Restrictions

You agree not to:

  • Copy, modify, distribute, sell, lease, or sublicense the App
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Bypass, disable, or interfere with security features
  • Use the App for unlawful, abusive, harmful, or unauthorized purposes
  • Interfere with or disrupt the operation of the App, devices, cloud systems, or related services

4. Account Responsibility

Some features require account registration. You are responsible for:

  • Maintaining account security
  • Protecting login credentials
  • All activity under your account
  • Keeping contact, notification, payment, and device information accurate and current

The App does not operate in the background to collect personal information unrelated to the operation of AlertBadger services. Technical information may be collected as necessary to make the App, alerts, notifications, and related services available for your use.


5. Alerts and Notifications

The App may deliver system alerts and notifications. Delivery of alerts may depend on:

  • Cellular networks
  • Internet connectivity
  • Power availability
  • Mobile device settings
  • Operating system notification permissions
  • Third-party cloud and notification services
  • Device placement, configuration, and maintenance

Because alerts may depend on third-party partners, wireless networks, internet service, power, weather, device settings, user configuration, and other conditions beyond the Company’s control, the Company cannot guarantee delivery, timing, or receipt of alerts.


6. System Dependencies

The App interacts with devices, gateways, cloud systems, mobile devices, and external networks. Performance may depend on:

  • Internet connectivity
  • Internet traffic and available speed
  • Cellular network availability
  • Device configuration
  • Compatibility and condition of user-owned devices
  • System maintenance
  • App updates
  • Environmental conditions
  • Proper installation and maintenance

7. Updates

We may release updates to improve functionality, security, compatibility, reliability, or performance. Some features may require updating the App to continue operating properly. Updates may happen with, or without, notification to the end user.


8. Termination

This license may be terminated if you violate this Agreement or misuse the App, devices, services, or related systems.

Abuse, misuse, unlawful use, unauthorized access, or interference with the system may result in deactivation of your services, with or without notice. The Company assumes no responsibility for any resulting inability to use the service or receive alerts following termination or deactivation.

Certain user selected features may be terminated for failure to complete payment obligations for monthly or annual monitoring plans. These may be restored with proper payment for services.

Upon termination, you must discontinue use of the App and remove it from your devices.


9. Disclaimer of Warranties

The App is provided “as is” and “as available.”

Due to the nature of advanced technology, third-party communication networks, cloud systems, the internet, mobile devices, environmental conditions, and other circumstances beyond the Company’s control, we make no warranties regarding:

  • Uninterrupted operation
  • Reliability
  • Error-free performance
  • Continuous availability
  • Delivery or timing of notifications
  • Compatibility with all devices, networks, or operating systems

10. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Special or incidental damages
  • Loss of property
  • Loss of data
  • Personal injury or death
  • Inability to use the system
  • Business interruption
  • Missed, delayed, or undelivered notifications

Any liability arising from use of the App, devices, services, delayed performance, or failure of the system shall be limited to the original purchase price paid for the applicable product or service.


11. Governing Law

This Agreement shall be governed by the laws of the State of Arizona, without regard to conflict of law principles.
